OFFICER USE OF DEADLY PHYSICAL FORCE INVESTIGATION

Pursuant to Senate Bill 111 of the 74th Oregon Legislative Assembly (2007) and as adopted in the City of Keizer Council Resolution 20081866.  When a use of deadly physical force results in death or serious physical injury, the department shall comply with the Law Enforcement Use of Deadly Physical Force Response Plan (the Plan).

Section 7, paragraphs 1 and 2 of the Plan dictate that the District Attorney’s Office shall be notified "immediately" after a use of deadly physical force that results in death or serious physical injury, and the DA’s Office will be consulted "regarding the investigation and implementation of [the] elements of" the Plan.

The Plan recommends that uses of deadly force that result in death or physical injury be investigated by members of an outside agency (Plan, Section 5, Paragraph 10).  Alternatively, the Plan dictates that "at least one officer from an outside agency shall be assigned to the investigation team in the event an agency investigates their (sic) own officer’s use of deadly force" (Plan, Section 5, Paragraph 10c).

Administrative reviews of uses of deadly physical force (cf., Plan, Section 5, Paragraph 11), shall be conducted as described in Policy Manual § 302.
